  1. ACCEPTANCE OF TERMS
  2. By accessing our website, placing an order, or submitting a “By The Pan” request, you agree to these Terms & Conditions (“Terms”). If you do not agree, please do not use our services.
  3. CHANGES TO TERMS
  4. We may update these Terms at any time. The “Last updated” date will change when we do. Your continued use after changes means you accept the updated Terms.
  5. ELIGIBILITY
  6. You must be at least 18 years old (or the age of majority in your jurisdiction) to place orders. Some items may have additional age restrictions as required by law.
  7. ACCOUNTS & SECURITY
  8. You’re responsible for keeping any account credentials confidential and for all activity under your account. Notify us immediately of any unauthorized use.
  9. PRODUCT / MENU INFORMATION
  10. We work to keep product, pricing and availability accurate, but errors may occur. We may change or discontinue items without notice. Photos are illustrative and actual presentation may vary.
  11. ORDER PROCESS & ACCEPTANCE
  12. Your order is an offer; we accept it by confirming the order or beginning fulfillment. We may cancel or refuse any order (e.g., suspected fraud, inventory limits, safety or compliance reasons). If we cancel before fulfillment, we’ll notify you.
  13. PRICING, TAXES & FEES
  14. Prices are shown before taxes and applicable fees. Sales tax and any delivery or service fees are added at checkout. Gratuities are optional unless stated otherwise for events.
  15. PAYMENTS
  16. We accept the payment methods shown at checkout and process payments through third-party providers. By submitting a payment, you authorize us (and our processors) to charge your selected method for the order total, taxes and fees.
  17. SHIPPING, LOCAL DELIVERY & PICKUP
  18. • Non-perishable items may be shipped via common carriers. Transit times are estimates only.
  19. • Perishable food is available for scheduled local delivery or pickup within our service area; we do not ship perishable items.
  20. • Full details, timelines and responsibilities are described in our Shipping & Deliveries Policy (which is incorporated into these Terms).
  21. PERISHABLE ITEMS & FOOD SAFETY
  22. Ownership and responsibility for perishable items transfer to you upon pickup or delivery. Follow proper storage and handling instructions. We are not responsible for quality issues due to delayed pickup/acceptance or improper storage.
  23. ALLERGENS & DIETARY NEEDS
  24. Our kitchen may handle common allergens. While we can note preferences, we cannot guarantee an allergen-free environment. You are responsible for informing us in writing of any allergies when ordering.
  25. “BY THE PAN” / CATERING TERMS
  26. • Lead time: Please submit requests as early as possible (typically 48–72 hours minimum; large events may require more notice).
  27. • Changes/Cancellations: Must be requested before we begin preparation. Once prep starts, orders cannot be canceled or changed.
  28. • Delivery/Setup Windows: We’ll confirm a window. If no one is available to receive the order, re-delivery may incur additional fees.
  29. • Equipment: Any loaned equipment must be returned in good condition; replacement fees may apply.
  30. NO REFUNDS — ALL SALES FINAL
  31. All purchases are final. We do not offer refunds. In limited situations and at our sole discretion, we may provide a replacement or store credit (this does not constitute a refund). Shipping fees and service charges are non-refundable.
  32. RISK OF LOSS & TITLE (NON-PERISHABLE SHIPMENTS)
  33. Risk of loss transfers to you when the carrier accepts the package. If tracking shows “delivered” but the package is missing, contact the carrier and then contact us; we’ll assist case-by-case.
  34. PROMOTIONS, CREDITS & GIFT CARDS
  35. Promotions and credits are subject to their own terms and may be changed or discontinued without notice. Gift cards (if offered) are not redeemable for cash unless required by law.
  36. INTELLECTUAL PROPERTY
  37. All content on our site—including logos, text, photos, menus and designs—is owned by us or our licensors and is protected by law. You may not copy, modify or use it without written permission.
  38. USER CONTENT & REVIEWS
  39. If you submit reviews, photos or feedback, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce and display that content for marketing and operational purposes.
  40. PROHIBITED USES
  41. You agree not to use our site or services for any unlawful purpose, to violate others’ rights, to attempt to gain unauthorized access or to interfere with security or operations.
  42. THIRD-PARTY SERVICES
  43. We use third-party providers (e.g., e-commerce host, payment processors, Formspree for form submissions). Their services are governed by their own terms and privacy policies.
  44. DISCLAIMER OF WARRANTIES
  45. Services and products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
  46. LIMITATION OF LIABILITY
  47. To the fullest extent permitted by law, Food With A Twist and its owners, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of our site or services. Our total liability for any claim will not exceed the amount you paid for the order giving rise to the claim.
  48. INDEMNIFICATION
  49. You agree to indemnify and hold us harmless from any claims, damages and costs (including reasonable attorneys’ fees) arising from your misuse of the site/services, violation of these Terms, or infringement of others’ rights.
  50. GOVERNING LAW & DISPUTE RESOLUTION
  51. These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state or federal courts located in [Wayne County, Michigan]. You and we may also seek relief in small-claims court where appropriate.
  52. SEVERABILITY; WAIVER; ASSIGNMENT
  53. If any provision is found unenforceable, the remaining Terms remain in effect. Our failure to enforce a right is not a waiver. You may not assign your rights or obligations under these Terms without our consent.
  54. ENTIRE AGREEMENT
  55. These Terms, together with our Shipping & Deliveries Policy and Privacy Policy, form the entire agreement between you and Food With A Twist regarding your use of our site and services.
